Protecting IDEA and Section 504 for Students with Disabilities
At The Arc of Macomb County, we believe that every person with a disability deserves access to a free and inclusive education — and that right is under threat.
Families and advocates across Michigan are sounding the alarm about proposed changes that would weaken or eliminate federal protections like the Individuals with Disabilities Education Act (IDEA) and Section 504 of the Rehabilitation Act. These laws guarantee students with disabilities the right to individualized support, equal access to learning, and freedom from discrimination.
The document below — developed by The Arc Michigan Education Committee — outlines what’s at stake, what’s happening in Washington, and what you can do about it. It’s designed for advocates, families, and anyone who cares about disability rights.
- What is IDEA?
A federal law that ensures eligible students with disabilities receive a free appropriate public education (FAPE) in the least restrictive environment. - What’s at risk?
Proposals to eliminate the U.S. Department of Education or move special education to the Department of Health and Human Services could:- Remove federal oversight
- Cut funding
- Eliminate IEPs and due process protections
- Redefine education as a social service instead of a civil right
- What about Section 504?
A current lawsuit (Texas v. Becerra) could dismantle Section 504 protections in schools, workplaces, healthcare, and beyond.
